Maverick Marketing provides direct mail marketing services including but not limited to targeted mailing list development, data modeling, postcard and mail campaign production, printing, fulfillment, and digital marketing extensions. The scope of services for each client engagement will be set forth in a separate written agreement, proposal, or statement of work.
By engaging our services, you represent and warrant that:
Payment terms will be outlined in your individual service agreement or proposal. Unless otherwise agreed in writing, invoices are due upon receipt. Maverick Marketing reserves the right to suspend or terminate services for any account with outstanding unpaid balances. All fees are non-refundable unless otherwise expressly stated in your service agreement.
Maverick Marketing makes no guarantee, warranty, or representation regarding specific campaign results, response rates, or return on investment. Direct mail and digital marketing results are inherently variable and depend on factors outside our control, including market conditions, offer quality, and recipient behavior. We will use commercially reasonable efforts to execute your campaign in accordance with the agreed-upon specifications.
Any creative materials, designs, or content developed by Maverick Marketing on your behalf remain the property of Maverick Marketing until payment in full has been received, at which point ownership transfers to the client unless otherwise agreed in writing. You retain all ownership rights to any materials, data, or content you provide to us.
Both parties agree to keep confidential any proprietary or sensitive business information shared in connection with the provision of services. This includes but is not limited to client customer data, campaign strategies, pricing, and business operations. This obligation survives the termination of any service agreement.
To the fullest extent permitted by applicable law, CSSN, LLC d/b/a Maverick Marketing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to our services shall not exceed the total amount paid by you to Maverick Marketing in the three (3) months preceding the claim.
You agree to indemnify, defend, and hold harmless CSSN, LLC d/b/a Maverick Marketing, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
Either party may terminate a service engagement upon written notice in accordance with the terms of the applicable service agreement. Maverick Marketing reserves the right to immediately terminate services if a client violates these Terms, engages in unlawful conduct, or fails to make timely payment. Termination does not relieve the client of any payment obligations for services already rendered.
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You may not attempt to gain unauthorized access to any portion of our website, interfere with its operation, or use automated tools to scrape or harvest data from our site.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Missouri.
